Getting ready for the new NDIS laws

There are a number of upcoming changes to the rules of the NDIS. The information that has been shared with participants and providers is being updated regularly. P2P will continue to add new information, resources and links to this story. You can save this link and keep checking back for updates.

4 October 2024

P2P has created a number of resources to help understand the different types of supports that can and cannot be claimed using the new NDIS rules.

This is broken down into a number of topics including housing, technology, recreation, food and more.

You can read more about these on our Participant Resource page under the section on the New Legislation Changes.

3 October 2024

The NDIS released a list of NDIS approved and not approved supports that can be claimed on 1 October in preparation for the changes to the legislation.

From today (3 October), participants will only be able to use their NDIS funds for items listed as approved supports. There is also a list of things NDIS funding cannot be used for. In some circumstances participants may be able to request a substitution from the replacement support list.

You can find the lists of supports on the NDIS website at this page:

https://ourguidelines.ndis.gov.au/would-we-fund-it/what-does-ndis-fund

It includes three files with information about:

  • Supports that are NDIS supports
  • Supports that are not NDIS supports
  • Replacement List (supports that may be able to be claimed with approval from the NDIA)

Easy read versions of these lists are available on the NDIS website as well.

You can read more about this in an easier to understand language on the Inclusion Australia website here: https://www.inclusionaustralia.org.au/resource/changes-to-the-ndis-legislation-made-simple/

Parent to Parent is working on resources and information for participants about the different types of supports that can and cannot be claimed and we will share these with participants very soon.

More information is expected in the next few days and you can continue to check in this post for updates. Or keep an eye on the NDIS website here: https://ndis.gov.au/changes-ndis-legislation

5 September 2024

On 22 August 2024, the Australian Parliament passed new NDIS laws. These changes are expected to be rolled out from the 3rd of October 2024 and will impact participants.

The main changes that participants can expect include:

  • Changes to the supports that can and cannot be purchased.
  • Changes to how eligibility is assessed (including the evidence that needs to be provided to the NDIA).
  • Changes to how a plan will be created, set up and reviewed.
  • Changes to how the funding is monitoried, tracked and claimed during the plan period.

Until the date of these changes is confirmed by the NDIA, participants are able to continue using their NDIS plan as usual. All processes and supports will stay the same for now.

The NDIA is gradually updating their information and resources for both participants and providers.  To read more about the changes and what this means, visit the NDIS website.

You can also read in depth about the changes, including a list of the proposed supports that can and cannot be claimed from NDIS funding on the DSS website.

If you would like the opportunity to be involved in surveys, discussions and feedback sharing about these changes, the NDIA has created a group called the Participant First Initiative. You can register your interest to join by clicking here.
